Student Contract

By clicking accept when creating an online account the student/client acknowleges they have read and gree to the following terms, policies and disclaimers as a legally binding contract between ACW, LLC. and the account holder.

1) ACW, LLC. DBA Actors Creative Workshop

2) ACW will host educational workshops, classes, events, and showcases to be taught by by independent teachers. We will also maintain a website for use under the terms of this agreement.  Use of the website is part of the service we provide and constitues the begining of the 10 day grace period covered under secion 5 of this agreement.  Services will be provide on an on-going basis.  Each servicable event is scheduled at the time of registration.  In the event a class is rescheduled or canceled the student will have the option of accepting the new date/time, recieving a voucher or credit, or may request a full refund.  Eligible refunds will be processed within 10 business days of the request.  The duration of this contract shall be on going until either party notifies the other of termination in writing or ACW, LLC terminates business operations.

3) A bond of $50,000 must be posted with the labor comission.  ACW, LLC is bonded with Suretec Insurance Company under bond number 5083572.

4) All fees for services are due at the time of registration and are clearly marked on each event page of www.trulyacting.com and in all email advertising.  

5) ACW, LLC. IS A TALENT COUNSELING SERVICE, TALENT LISTING SERVICE, OR TALENT TRAINING SERVICE (whichever is applicable). THIS IS NOT A TALENT AGENCY CONTRACT. ONLY A TALENT AGENT LICENSED PURSUANT TO SECTION 1700.5 OF THE LABOR CODE MAY ENGAGE IN THE OCCUPATION OF PROCURING, OFFERING, PROMISING, OR ATTEMPTING TO PROCURE EMPLOYMENT OR ENGAGEMENTS FOR AN ARTIST. (Name of talent service) IS PROHIBITED BY LAW FROM OFFERING OR ATTEMPTING TO OBTAIN AUDITIONS OR EMPLOYMENT FOR YOU. IT MAY ONLY PROVIDE YOU WITH TRAINING, COUNSELING, OR LISTING INFORMATION (whichever is applicable). FOR MORE INFORMATION, CONSULT CHAPTER 4.5 (COMMENCING WITH SECTION 1701) OF PART 6 OF DIVISION 2 OF THE LABOR CODE. A DISPUTE ARISING OUT OF THE PERFORMANCE OF THE CONTRACT BY THE TALENT SERVICE THAT IS NOT RESOLVED TO THE SATISFACTION OF THE ARTIST SHOULD BE REFERRED TO A LOCAL CONSUMER AFFAIRS DEPARTMENT OR LOCAL LAW ENFORCEMENT, AS APPROPRIATE.

YOUR RIGHT TO CANCEL

You may cancel this contract and obtain a full refund, without any penalty or obligation, if notice of cancellation is given, in writing, within 10 business days from the above date or the date on which you commence utilizing the services under the contract, whichever is longer. For purposes of this section, business days are Monday through Friday.
To cancel this contract, mail or deliver or send by facsimile transmission a signed and dated copy of the following cancellation notice or any other written notice of cancellation to (name of talent service) at (address of its place of business), fax number (if any), email address (if any), and Internet Web site address (if any), NOT LATER THAN MIDNIGHT OF (date). If the contract was executed in part or in whole through the Internet, you may cancel the contract by sending the notification to: (email address).

6a) After the 10 day period beging on the date you first created your online account and accepted these terms, no refunds will be granted for any reason.
6b) By clicking 'accept' when creating an account, the student agrees that they have read and agree to the provided statements, terms and policies.  A link to this contract is available to review in the 'accept' pop up box and on our homepage at: www.trulyacting.com
6c) ACW, LLC. does not currently use the likeness, photo, name or credits of our students on our website or in any advertising.  However, in the event we do one day, the student may request it's removal and we will comply within 10 business days.  Please email any quests to: info@trulyacting.com.
 
 
 

PAYMENT POLICIES:

  • Payment is due in full on or before the first class session.
  • All sales are final and nontransferable.
  • There are no exchanges or refunds for missed class sessions.
  • Returned checks will incur a $35 canceled-check fee.
  • You will be held financially accountable for your commitment once you are confirmed.
  • Payment plans are available upon special request for a $5 fee and subject to availability.
  • Payment plans are a binding contract holding you financially obligated for the full amount, regardless of attendance. Late fees will be applied.
  • If using a payment plan, your credit card on file will be automatically charged half-way through the class or workshop.

ATTENDANCE POLICIES:

  • You are responsible for attending your class or workshop.
  • If you are going to be absent you must cancel through your online account at www.trulyacting.com - we do not accept ANY cancellations via email or phone.
  • To request a voucher, we require at least 48 hours notice prior to your class or workshop.
  • Within 48 hours a voucher will only be granted if the class sells out and we are able fill your seat with someone off the wait list.
  • If eligible, you will be issued a voucher to attend a comparable class or workshop within 6 months.

VOUCHER POLICIES:

  • A Voucher holds no cash value. It is a coupon to attend one night of a comparable class or workshop, and cannot be refunded.
  • To redeem a voucher, you must reserve a seat through your online account at www.trulyacting.com prior to the start of class and subject to availability.
  • Once a voucher is scheduled, it cannot be re-issued.
  • Failure to attend an event that is scheduled will result in forfeiture of the voucher.
  • You are allowed 1 voucher in any 1,2,3, or 4-week session and 2 vouchers in any 6-week session, with the exception of special events.
  • No vouchers will be granted for special events, including but not limited to: agent/manager showcases, special guest instructors, or all day intensives.
  • Vouchers are valid for 6 months from the date of the missed class and kept on file at ACW.

COUPONS/DISCOUNT POLICIES:

  • You are responsible for informing ACW when applying credits or discounts at the time of purchase. They cannot be awarded after the purchase is made.
  • Special discounts are only valid for classes purchased the day of the special and will not be given to purchases made prior to or after the date of the special.
  • When using a coupon, discount, best price guarantee or any special offer of any kind, ALL SALES ARE FINAL.  No vouchers, refunds, exchanges will be awarded for any reason.  No exceptions.

PRIVACY POLICIES:

  • We collect information from you when you register on our site, place an order or fill out a form.
  • We do not sell, exchange, transfer or give your information other than for the express purpose of delivering the purchased service requested.
  • By signing up for an account you will automatically be added to our email list. You may unsubscribe at any time by following the instructions in the email, or by sending a request to: info@trulyacting.com
  • We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.
  • After a transaction, your private information (credit cards, social security numbers, financials, etc.) will not be stored on our servers.
  • As part of the California Online Privacy Protection Act, all users of our site may make any changes to their information at anytime by logging into their control panel and going to the 'Edit Profile' page.
  • We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.
  • I grant officials of ACW, LLC. the right to utilize and/or reproduce photographs, likenesses, the voice, or written articles of, any legal manner, including but not limited to success stories for the internal or external promotional/informational activities of Actor's Creative Workshop or any of it's affiliates.
  • I understand that I waive any and all present or future compensation rights to the use of the above stated material(s).

DISCLAIMERS:

ACW is bonded and licensed:

A workshop is not a job interview or audition. The presence of a casting director, agent or manager is neither a guarantee nor a promise of employment. The intent of the class is solely educational. Attending a workshop is not a way to obtain employment as an actor. Such contact as you may have with a casting director at a workshop rarely results in any further contact with that casting director or any company affiliated with that casting director.

CSA disclaimer:  'This workshops is a learning experience.  It is not an employment opportunity.  When the worshop is over the Casting Director/Casting Associate (whichever is applicable) teaching this workshop will not be taking home, nor be given access to your headshot, resume or any other of your promotional materials.' 

Although ACW makes every effort to keep you informed of our guest’s schedules, previous credits, and offices, we reserve the right to change the workshop date, credits and offices of our industry guests at any time and without notice. Please know, this is due to the ever-evolving nature of the entertainment industry. ACW respects your time and will always strive to give you as much notice as possible when changes are necessary. Thank you for your patience and understanding.

Actors Creative Workshop reserves the right to terminate membership at any time. By submitting information, the actor agrees to release Actors Creative Workshop of any liability. Please see our Privacy Policy for information on your membership and how we protect your information.

By using our site, creating an online account, attending any class or workshop, you consent to all ACW policies and acknowledge that you understand the purpose of a workshop, class or showcase is purely educational.  You acknowlege  that you do not expect, either directly or indirectly, an audition or employment oportunity as a result of attending any class, workshop, event, or showcase at ACW.
